SMS Texting Privacy Policy

1. Introduction
At the office of Peter Cusimano, Barrister & Solicitor, we value your privacy and are committed to protecting your Personal Information (as defined below). This SMS Texting Privacy Policy (the “Policy”) outlines how we collect, use, and protect the Personal Information that we collect and receive from you through the sending and receiving of SMS text messages with you (the “SMS Service”).
“Personal Information” means information that individually identifies you, such as your mobile phone number or user/screen name, as well as any information that you include in messages you send to us through the SMS Service.
2. Collection of Personal Information
When you opt-in to receive SMS text messages from us or communicate with us using the SMS Service, we will receive and collect the following information:
- Your mobile phone number that you used to send the SMS text message to us
- Any information you provide in your SMS text messages
3. How We Use Personal Information
We use the information collected through SMS text messages to:
- Communicate with you regarding your legal matters
- Assist us in providing legal services to you for your legal matters
- Provide updates and information about our legal services
- Respond to your enquiries and requests
4. Non-Sharing Clause
We do not share or sell to third parties any information collected from you for marketing purposes. We also do not share with third parties any information collected from you for any other purposes, except as follows:
- With your consent
- Where we are legally obligated to do so by law, court order, legal process
- Pursuant to the rules of professional conduct governing lawyers in the Province of Ontario
- Where we are permitted to do so pursuant our legal retainer services agreement with you
5. Data Retention
Your Personal Information is kept as long as we are required or permitted to do so by the Law Society of Ontario and any other industry practices for lawyers in the Province of Ontario.
6. Data Security
We implement appropriate technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. Despite our efforts, we cannot guarantee that hackers or unauthorized personnel will not gain access to your Personal Information. In using the SMS Service, any SMS text messages that you send to us will travel through third-party systems which are not under our control, including your carrier network, our carrier network, and any intermediary network. The Personal Information in SMS text messages will be stored in your file on our computers and on our secure client management system.
7. Opt-Out
You can opt-out of receiving SMS text messages from us at any time by replying "STOP" to any message you receive. Upon receipt of your opt-out request, we will promptly remove your mobile phone number from our SMS text messaging list.
8. Changes to This Policy
We reserve the right in our sole discretion to amend this SMS Texting Privacy Policy from time to time. Any amendments will be posted on our website, and the effective date will be updated accordingly. Your continued use of the Service following the posting of any changes to our SMS Policy constitutes your acceptance of the amendments.
